Terms and Conditions (User Agreement)

1. Introduction and Acceptance

Welcome to TalentEU ("the Platform," "we," "us," "our"), accessible at https://talenteu.eu.

These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," "your") and TalentEU.

By accessing or using TalentEU, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Key Definitions:

  • Candidate: A job seeker who creates a profile to find employment opportunities.
  • Employer/Recruiter: A company or individual posting job vacancies.
  • Premium User: A user who subscribes to paid features.
  • Content: Any information, text, images, files, or data uploaded by users.

2. Eligibility

2.1 Age Requirement

You must be at least 16 years old to use TalentEU. By registering, you confirm that you meet this requirement.

2.2 Geographic Scope

TalentEU is designed for users in the European Union (EU), European Economic Area (EEA), United Kingdom (UK), Switzerland, and Norway. While we do not restrict access from other locations, our primary focus is employment within these regions.

2.3 Legal Capacity

You represent that you have the legal capacity to enter into this Agreement and are not prohibited by law from using recruitment platforms.


3. User Accounts

3.1 Account Registration

Candidates:

  • Provide accurate information (name, email, professional background)
  • Upload an authentic CV/Resume
  • May not impersonate others or create fake profiles

Employers/Recruiters:

  • Provide accurate company information
  • Verify business legitimacy (we may request documentation)
  • May not post fraudulent, discriminatory, or illegal job listings

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your password.
  • Notify us immediately if you suspect unauthorized access: security@talenteu.eu
  • We are not liable for losses due to stolen credentials unless we failed to implement reasonable security measures.

3.3 Account Termination

  • By You: You may delete your account at any time via Settings → Delete Account.
  • By Us: We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in cases of severe violations (fraud, illegal activity).

4. User Roles and Responsibilities

4.1 Candidates (Job Seekers)

You May:

  • Create a profile and upload your CV
  • Search for jobs and apply directly to employers
  • Receive job recommendations (if you opt in)
  • Use basic features for free; upgrade to premium for advanced tools

You Must NOT:

  • Upload fabricated CVs, fake credentials, or plagiarized content
  • Spam employers with irrelevant applications
  • Use automated bots or scrapers to harvest data
  • Share login credentials with others

4.2 Employers/Recruiters

You May:

  • Post job vacancies (subject to our approval)
  • Review candidate profiles and applications
  • Contact candidates who apply to your jobs
  • Use premium features for enhanced visibility (if subscribed)

You Must NOT:

  • Post discriminatory job listings (violating EU anti-discrimination laws)
  • Request sensitive information illegally (e.g., health data, genetic information, without justification)
  • Misrepresent job details (fake salaries, bait-and-switch tactics)
  • Use candidate data for purposes other than recruitment (e.g., marketing, selling to third parties)
  • Scrape or mass-download candidate profiles

5. Job Postings and Content

5.1 Employer Responsibility

Employers are solely responsible for the accuracy and legality of their job postings. TalentEU does not verify the legitimacy of every job posting but will remove fraudulent listings upon notice.

5.2 Prohibited Job Content

The following are strictly prohibited:

  • Discriminatory language based on race, gender, age, religion, disability, sexual orientation, or nationality (violates EU Directive 2000/78/EC)
  • Illegal activities (e.g., money laundering schemes, pyramid schemes)
  • Jobs requiring upfront payment from candidates
  • Adult/sexual content or escort services
  • Jobs that violate labor laws (e.g., below minimum wage, forced labor)

Violation Consequences: Immediate removal of listing, account suspension, and potential reporting to authorities.

5.3 User-Generated Content

  • You retain ownership of your content (CVs, cover letters, portfolio items).
  • By uploading content, you grant TalentEU a non-exclusive, royalty-free, worldwide license to store, display, and process it solely for the purpose of providing our service.
  • We do not claim ownership but may use anonymized, aggregated data for analytics (e.g., "Top skills in demand: Python, React").

6. Intellectual Property

6.1 Platform Ownership

The TalentEU website, including its design, code, logos, trademarks, and original content, is owned by TalentEU or its licensors. All rights reserved.

6.2 Prohibited Uses

You may NOT:

  • Copy, modify, distribute, or reverse-engineer any part of the Platform
  • Use our logo or branding without written permission
  • Create derivative works based on our codebase or design

6.3 User Content

Your uploaded content (CVs, profiles) remains yours. We do not sell or claim ownership of it.


7. Premium Features and Payments

7.1 Freemium Model

  • Free Tier: Basic job search, profile creation, limited applications per month.
  • Premium Tier: Unlimited applications, advanced filters, profile highlighting, priority support (prices listed on the website).

7.2 Subscription Terms

  • Premium subscriptions are billed monthly or annually (your choice).
  • Auto-Renewal: Subscriptions renew automatically unless canceled 24 hours before the renewal date.
  • Refunds: We offer a 14-day money-back guarantee for first-time premium users (EU consumer rights). Subsequent renewals are non-refundable unless we fail to provide the service.

7.3 Payment Processing

Payments are handled by Stripe or PayPal. We do not store credit card numbers. By subscribing, you agree to their terms of service.

7.4 Taxes

Prices may be subject to VAT or other taxes depending on your location (handled automatically by the payment processor for EU users).


8. Platform as an Intermediary

8.1 No Employer-Employee Relationship

TalentEU is a job board and matching platform. We do NOT:

  • Employ candidates or act as a recruitment agency
  • Guarantee the quality, legitimacy, or safety of jobs posted
  • Enter into employment contracts on behalf of employers

You acknowledge that:

  • TalentEU is an intermediary (two-sided marketplace).
  • Employment relationships are between candidates and employers directly.
  • We are not responsible for disputes arising from job offers, interviews, or employment contracts.

8.2 No Guarantees

  • For Candidates: We do not guarantee you will find a job or receive responses from employers.
  • For Employers: We do not guarantee you will find suitable candidates or fill open positions.

9. Limitation of Liability

To the maximum extent permitted by law:

9.1 No Warranty

TalentEU is provided "AS IS" without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Accuracy or completeness of job listings or candidate profiles

9.2 Limitation of Damages

We are NOT LIABLE for:

  • Indirect, incidental, or consequential damages (e.g., lost profits, reputational harm, lost opportunities)
  • Damages arising from reliance on job postings or candidate information
  • Technical issues (downtime, bugs, data loss) beyond our reasonable control
  • Third-party actions (e.g., employer fraud, candidate misrepresentation)

Maximum Liability: Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim (or €100 if you are a free user).

9.3 Mandatory Liability (EU Law)

Nothing in these Terms limits liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Liabilities that cannot be excluded under EU consumer protection laws

10. Indemnification

You agree to indemnify, defend, and hold harmless TalentEU, its affiliates, directors, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Content you upload (if it infringes copyright, defames someone, etc.)
  • Your use of the Platform in an unauthorized manner

11. Acceptable Use Policy

You agree NOT to:

11.1 Prohibited Activities

  • Scraping: Use bots, scripts, or automated tools to extract data
  • Spamming: Send unsolicited messages to users
  • Hacking: Attempt to breach security, access unauthorized areas, or disrupt the Platform
  • Impersonation: Pretend to be someone else or a company you do not represent
  • Harassment: Bully, threaten, or harass other users

11.2 Content Restrictions

Do not upload:

  • Malware, viruses, or malicious code
  • Pornographic or sexually explicit material
  • Hate speech, discriminatory, or defamatory content
  • Copyrighted material without permission

Consequences: Immediate account termination, IP ban, and potential legal action.


12. Data Privacy and GDPR Compliance

Your use of TalentEU is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.

Key Points:

  • We only share your CV with employers when you apply to a job.
  • You have the Right to be Forgotten (delete your account and data at any time).
  • We do NOT sell your data to advertisers or third parties.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes shall be resolved in the courts of Munich, Germany.

13.3 EU Online Dispute Resolution

If you are an EU consumer, you may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

13.4 Arbitration (Optional)

By mutual agreement, disputes may be resolved through binding arbitration under ICC International Chamber of Commerce Rules to save time and costs.


14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

  • Immediately for minor corrections (typos, clarifications)
  • 30 days after notice for material changes

Notice Methods:

  • Email notification (if you have an account)
  • Prominent banner on the website
  • Updated "Last Updated" date at the top of this page

Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Platform and may delete your account.


15. Termination and Suspension

15.1 Termination by You

You may terminate this Agreement and delete your account at any time via Settings → Delete Account or by emailing privacy@talenteu.eu.

15.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • You harm our reputation or disrupt the Platform
  • We discontinue the service (with 30 days' notice)

Effect of Termination:

  • Your access to TalentEU is revoked
  • Your data is deleted according to our Privacy Policy (6 months retention unless you request immediate deletion)
  • Premium subscriptions are canceled (no refunds unless legally required)

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and TalentEU.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

16.3 No Waiver

Our failure to enforce a right does not waive that right.

16.4 Assignment

You may not assign or transfer your account. We may assign these Terms to a successor entity (e.g., if acquired).

16.5 Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (natural disasters, wars, pandemics, government actions, internet outages).

18. Acknowledgment

By clicking "I Agree" during registration or by using TalentEU, you acknowledge that:

  1. You have read and understood these Terms.
  2. You agree to be bound by them.
  3. You have reviewed the Privacy Policy and Cookie Policy.

If you do not agree, you must not use the Platform.
